Article II, Section 4 of the Constitution

The President, Vice President and all civil Officers of the United States, shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors.

And quite frankly, even if this got passed the house of representatives, it would never get out of the Senate committee, at least not until the majority shifts in the Senate.

So in that light the dude's timing sucks.....
