Went to Justin's sentencing on December 14th. It is not good. Justin got 15 years with a 3 year fixed sentence. That means that he will have to do a minimum of 3 years in prison. The Judge gave him an opportunity to do a "Rider Program". The Rider program is where the Judge sends him to a place in Cottonwood, Idaho (a prison) for six months. After the six months is over and the programs are completed to satisfaction then the person comes back before the Judge and the Judge decides if that person can do the rest of his time on probation or do the rest of the time in jail.
Justin would then have to complete several things to graduate from the program. The Judge told Justin that the program is easy for the ones that got to it under other circumstances. The Judge said that the "bar" is set at "ankle" height for those people and it is pretty easy for them to do the program. The Judge told Justin that his crime was so heinous and deliberate that he is setting the bar for Justin at "chin" height. He told Justin that if he even messes up once in the program that he will pull him out and send him to prison from there. The Judge told Justin that he was just using the Rider Program on him as a "evaluation" to see how well Justin response to the higher set program. The Judge told Justin that it is a high possibility that Justin will do the three years even after the programs over.
The Judge said he looked over the case and read several incidents involving Justin that happened in the Jail while he was in custody. The Judge told Justin that he has never excepted responsibility for any of his actions and that he thinks Justin is a high risk to society if he was just given probation. He told Justin that he could come out of this a better person, or a very educated criminal and that the choice was up to Justin.
I do not think Justin has it in him to complete the program or able to stay out of trouble to do just the three years. I look at him possible doing at least 7 to 10 years. Justin also has to pay restitution to the victim and the hospitals bills to date are $68,814.23. There will be more added to that as then victim gets rehab and possible more surgery. The Judge stated that it could go as high as $97,000.
